Dear Valued Customers and Partners,
As you are aware, today the decision in Learning Resources, Inc. v. Trump and V.O.S. Selections, Inc. v. Trump was released by the United States Supreme Court. This decision makes clear that the President did not have the authority to impose fentanyl, trafficking, or reciprocal tariffs under the International Emergency Economic Power Act (IEEPA). Thus, the tariffs are struck down and can no longer be applied.
The Supreme Court’s decision may be clear, but what follows now is anything but. At this time, there is no official guidance about when the tariffs will cease to be applied at the time of importation. There is no official guidance on whether refunds will be issued to importers of record or how those refunds will be processed. At this time, we continue to await further guidance. We are just as eager as you to know what the next steps are and how to abide by any new policy guidelines.
Just as we did on Liberation Day, Catalynt restates our commitment to seek clarity and advocate for specific guidance. Until such time as clear and official guidance is issued, we will proceed with conducting our business in accordance with all applicable laws and regulations.
